Credit Application Terms & Conditions

Privacy Consent

Pursuant to Sections 18K(1)(b) of the Privacy Act 1988 (Cth), consent is hereby given to Geelong Access Hire PTY Ltd ABN 66 639 516 144 to seek consumer credit information and trade references.

Credit Authority

Authority is hereby given to Geelong Access Hire PTY Ltd to obtain a credit report on my/our credit worthiness from any or all of the listed business references or from a credit reporting agency and if Geelong Access Hire PTY Ltd considers it necessary, a bank statement (not bank opinion) may be obtained.

Payment Terms

Unless otherwise agreed in writing, payment terms are settlement within 30 (Thirty) business days of issuance of a tax invoice. A purchase order is required.

Overdue accounts will attract interest at a rate of 1.5% per month.

Hire Agreement Terms

It is hereby agreed that all trading with Geelong Access Hire PTY Ltd is governed by the Hire Agreement Terms and Conditions as set out in the Hiring Policy.

Credit Limit

The credit limit approved by Geelong Access Hire PTY Ltd will be communicated in writing following assessment of the credit application. Geelong Access Hire PTY Ltd reserves the right to vary or withdraw credit facilities at any time.

Default

In the event of default in payment, Geelong Access Hire PTY Ltd reserves the right to:

• Suspend or cancel the credit account;
• Charge interest on overdue amounts at a rate of 1.5% per month;
• Recover all reasonable costs of collection, including legal costs, on a solicitor-client basis.

Personal Property Securities Act (PPSA)

The applicant consents to Geelong Access Hire PTY Ltd registering a security interest under the Personal Property Securities Act 2009 (Cth) in respect of all goods supplied on credit. The applicant agrees to do all things reasonably required to assist Geelong Access Hire PTY Ltd to register and maintain such a security interest.

Governing Law

These terms and conditions are governed by the laws of the State of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Victoria.
